TERMS AND CONDITIONS FOR CLAIMS/WARRANTIES

EXAKTUS provides a guarantee for certain products it sells. The terms and conditions of these warranties are set out below:

1 – All products marketed by EXAKTUS are duly certified by the competent international entities.

2 – Equipment and accessories have a warranty period defined by the manufacturer, which under legal terms can range from 1 to 2 years. This period is considered from the date of the equipment invoice and can only be exercised upon presentation of the guarantee certificate and/or proof of purchase (invoice) and the form “Request for Complaint/Guarantee” duly completed. In the case of EXAQUA products, the guarantee is guaranteed for up to 2 years after the sale/gift of the product to the end customer and upon presentation of the respective proof.

3 – Products that have exceeded the period defined by the manufacturer or have defects caused by abnormal wear, improper installation, negligence, poor handling and technical interventions by unauthorized personnel are considered to be outside the warranty conditions.

4 – If the equipment breaks down, and if it is covered by the guarantee, the customer may take it to the EXAKTUS facilities, accompanied by the “Request for Complaint/Guarantee” form, duly completed and proof of purchase and/or guarantee.

5 – In the case of implants, they are only covered by the guarantee when there is implant failure or fracture. The guarantee can only be exercised by sending the duly completed “Request for Claim/Guarantee” form, accompanied by the failed product and other components placed by the treatment provider, to EXAKTUS, within a period of three months after the failure/fracture of the product. . NOTE: The product must be sent to EXAKTUS, duly sterilized and in sealed, resistant packaging that proves the sterilization carried out by color.

6 – The implants and/or accessories covered by the guarantee, which break down, must be sent, with the form “Request for Complaint/Guarantee” duly completed and the respective proof of purchase and/or guarantee, to the following address: EXAKTUS, Material de Reabilitação Oral Ltd, Rua de Laborim 68, 4430-128 Vila Nova de Gaia.

7 – EXAKTUS may, at any time, change or terminate part or all of these conditions. The amendment or termination of these conditions will not affect the guarantee rights guaranteed under these conditions regarding products purchased on a date prior to the amendment or termination.

With regard to claims, these are the conditions:

1 – The customer may submit any contractual conflicts, to arbitration and mediation mechanisms that are or may be legally constituted, as well as complain to EXAKTUS of acts or omissions that violate the legal provisions applicable to the acquisition of goods.

2 – The complaint must be presented within a maximum period of 30 days and by filling out the “Request for Complaint/Guarantee” form, counted from the knowledge of the facts by the customer, being registered in the information systems of EXAKTUS that must decide the complaint , according to the deadlines defined in internal procedures.
